This Privacy Policy explains how Talksy Team ("Talksy", "we", "us", or "our") collects, uses, discloses, and protects information when you use the Talksy mobile application and related services (the "Service").

1) Who the Service is for (Age 17+)

The Service is intended for users who are 17 years of age or older. We do not knowingly collect personal information from individuals under 17. If you believe a user under 17 has provided personal information, please contact us and we will take appropriate steps to delete it.

2) Information We Collect

We collect information in three ways: (a) information you provide, (b) information collected automatically, and (c) information collected with your permission.

2.1 Information You Provide

  • Account information: name, username, email address.
  • Customer support content: messages, attachments, and other information you submit when contacting support.
  • User content (fragrance library content): photos/images you upload, notes you write, and details you input (e.g., brand, accords, scent notes, intended use), collections you create, and comparisons you build.

2.2 Information Collected Automatically

  • Device information: device model, operating system version, language, and app version.
  • Usage data: interactions, feature usage, in-app events, and approximate time/behavior patterns (e.g., screens viewed).
  • Diagnostics: crash logs and performance data.

2.3 Location Information (Optional)

If you grant permission, we may collect and use precise or approximate location information to support location-related features and improve the Service. You can turn off location access at any time in your device settings.

2.4 Cookies and Similar Technologies (Where Applicable)

If the Service includes web-based components (for example, sign-in pages or embedded web views), we may use cookies or similar technologies (which may include web beacons) to maintain login sessions, store preferences, help protect the Service, and measure usage.

3) How We Use Information

  • Provide, operate, and maintain the Service
  • Create and manage accounts, and enable login
  • Store, sync, and display your fragrance library content
  • Personalize your experience (e.g., preferences and organization)
  • Improve features, usability, and performance (including debugging and crash resolution)
  • Provide customer support and respond to requests
  • Protect security, prevent fraud, and enforce our terms
  • Comply with legal obligations and respond to lawful requests
We do not sell personal information.

4) Photos, Face Data, and Biometric Information

The Service may allow you to upload photos for managing your fragrance library.

  • No face recognition / biometrics: We do not perform facial recognition and do not create or collect biometric identifiers or biometric information for identification purposes.
  • Not used for marketing or training: Your photos and associated content are not used for advertising/marketing profiling and are not used to train third-party models.
  • Default storage: Your fragrance library content is intended to be stored in the app and/or your account as part of the Service experience. Specific storage behavior may depend on your settings and the Service configuration.

5) AI-Related Processing (If You Choose to Use It)

Some features may offer AI-assisted processing of user-provided text and/or images (for example, to help summarize notes, structure scent information, or generate helpful descriptions). If you choose to use these features:

  • User control: You decide whether to upload content for AI-assisted processing and whether to generate outputs.
  • Processing location: Your uploaded text/images are processed on Talksy Team servers (our own infrastructure), not by third-party AI providers.
  • No third-party sharing: We do not share the content you submit for AI-assisted processing with third parties.
  • Deletion after processing: Content submitted for one-time AI-assisted processing is deleted from our processing systems promptly after processing is completed.
If you do not use AI-assisted features, the AI processing described above does not occur.

6) How We Share Information

We may share information only as described below, and only to the minimum extent necessary:

  • With your consent: if you direct us to do so or give consent.
  • Service providers (processors): trusted vendors under our instructions and safeguards.
  • Legal, safety, and rights protection: to comply with law or protect the Service and stakeholders.
  • Business transfers: as part of a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, subject to appropriate safeguards.

7) International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) or equivalent mechanisms.

8) Security

  • Encryption in transit and (where applicable) at rest
  • Access controls and least-privilege practices
  • Regular reviews/audits and monitoring
  • Backups and recovery procedures

No system is 100% secure, and we cannot guarantee absolute security.

9) Data Retention

  • Account data and fragrance library content: retained for the duration of your account.
  • Account deletion: deleted or anonymized within 30 days, subject to legal requirements.
  • Usage analytics: retained for up to 12 months (typically aggregated or pseudonymized where feasible).
  • Support content: retained for up to 6 months after the support matter is closed.

10) Your Privacy Rights and Choices

Depending on where you live, you may have rights such as:

  • Access your personal information
  • Correct inaccurate information
  • Delete your information
  • Restrict or object to certain processing
  • Withdraw consent where processing is based on consent

11) Third-Party Services and Links

The Service may contain links to third-party websites or services that we do not control. This Privacy Policy does not apply to those third parties, and we encourage you to review their policies.

12) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice within the Service or by other appropriate means. The "Effective Date" above indicates when this Privacy Policy was last updated.

13) Dispute Resolution; Governing Law

This Privacy Policy is governed by the laws of the jurisdiction where Talksy Team has its principal place of business, without regard to conflict-of-law principles. Any dispute arising out of or relating to this Privacy Policy or the Service will be resolved by binding arbitration, except where prohibited by law. Arbitration procedures and venue will be determined in accordance with applicable rules and the jurisdiction of the principal place of business. You may also have rights to bring claims in small claims court if eligible.
